Retired civil defence servant wants court to terminate his marriage over lies

Sitting before the president if the customary court of appeal, One Eda on 12th July 2017, a retired civil servant. Jimoh Basau Olugbenga appealed to the court to terminated his union with his wife; Temidayo Eunice Basua over lies.

12th July happened to be the second appearnce of the plaintiff in the court . During his first appearance which was on 24th may 2017, the court president gave his ruling by asking both parties to  bring in someone who will stand in for them.

Appearing before the court president, the plaintiff presented his elder brother as a witness and the proponent brought in her counsellor.

 Jimoh pleaded with the court to give him two- three (2-3)weeks of grace in order to get his evidence ready.
" I pleased with the court to give me two- three weeks of break so that I can get my evidence ready on why I am seeking the court to terminate my marriage" , the plaintiff told the court.

In order for the court to grant the plaintiff his request, the court president asked the proponent if she was okay with the extension of the case  ,she simply said " yes".

Meanwhile, the counsel to both parties , Mrs Bukola Alabi, a representative of the office of public defender also pleaded with court to stretch the case for two weeks by granting the plaintiff his request.

The court president R. A Omotola in his ruling,told the court that the plaintiff has been granted a request of two weeks extension of the case so as to make his evidence ready for the next appearing date.

Omotola read: " since the defendant seek for the adjournment of the matter for a reason known by him,this case will be adjourned till 26th July 2017 either for the termination or continual of the case".

The court president therefore advised both parties to allow peace reign and he adjourned the case till 26th July 2017 for further hearing.
